my knowledge of the Polish language is poor, therefore I write in English.

The user Constrado with probably Polish roots has recently changed the Polish state border in the Pomeranian Bay.

He refers to Polish sources and also to the “United Nations Convention on the Law of the Sea”.

My research on it has shown:
The course of the border was laid down in a treaty between the Republic of Poland and the German Democratic Republic in 1989.
In 1995, the Polish Council of Ministers adopted a decision according to which access to the sea (north approach) to the two ports (Świnoujście and Szczecin) was to be regarded as Polish territory. In the light of the 1990 Treaty, which was valid under international law, this was a unilateral dispute without any basis in international law.

In fact, I can only say that the drawing complies with Polish law. Pursuant to Article 5 point 2a of the Act and the Regulation of the Council of Ministers of 13 January 2017 on the detailed course of the baseline, the external border of the territorial sea and the external border of the adjacent zone of the Republic of Poland.

In this forum, we will not solve the problem of compliance with international law, i think.

Wie Kollege sorbovit schon geschrieben hat, das hier ist wahrscheinlich nicht der beste Platz um rechtlich-politische Probleme zu diskutieren. Kannst Du uns aber bitte sagen wie schaut der Grenzverlauf auf diesem Abschnitt aus deutschem Sicht aus? Ich meine damit Grenzverlauf der vom Staat Bundesrepublik Deutschland anerkannt und dort gültig ist. Ist das wirklich anders als die polnische Version?

Ich habe lange gesucht und endlich was passendes gefunden. Schau bitte hier: http://archiv.nationalatlas.de/wp-content/art_pdf/Band11_44-45_archiv.pdf Die zweite Karte von Oben zeigt Deutsche Verwaltungsgrenzen in der Ostsee in 2004. Das ist keine polnische Version sondern stammt von Leibniz-Institut für Länderkunde. Daraus kann man zwar nicht direkt schlissen das der schmale Streifen zu Polen gehört, die polnische Version verletzt aber keinesfalls deutsche Außengrenze. Die ist sogar auf dem Abschnitt als nicht umstritten bezeichnet. Die Außschliesßliche Wirtschaftszone ist in diesem Bereich nicht eindeutig gekennzeichnet scheint aber sich mit Verlauf der polnischen Grenze zu überdecken. Ich nehme an - seit dem hat sich nicht viel geändert. Grüße nach Deutschland!

According to Regulation of the Council of Ministers of February 22, 1995 on establishing the roadsted border for seaports in Świnoujście and Szczecin (http://prawo.sejm.gov.pl/isap.nsf/DocDetails.xsp?id=WDU19950200101) this area is a roadsted for this ports… And according to quoted before Law of the Sea:

Taking the above into consideration in my opinion (I’m neater a lawyer nor a sea-law-specialist) everything is fine here… I’ve also checked other official sources and they are showing this border exactly like it was done by Constrado.

So… Constrado’s work is correct with our law - if you think that it’s not correct this means that polish government violated international conventions or agreements…

I have once researched how the sea border came about as an outer conclusion of the coastal seas of both states.
Initial situation: Dispute about the rights in the Pomeranian Bay from a Polish point of view (sorry, written in German, but maybe someone will find the Polish original)

Result: Agreement of May 22, 1989 between Poland and the GDR ---- Map to it (sorry in German, maybe somebody will find the Polish expression)
1990 Agreement between the Federal Republic of Germany and Poland in which the status of the border demarcation between the GDR and Poland in the Oder Bay (Pomeranian Bay) is recognised as valid.
I haven’t found a source in which anything is written about a termination of the border contract. My conclusion as a non-lawyer: the course of the border is valid as it was sealed in the 1989 agreement.

At the moment when Poland proclaims the part of the roadstead and the fairway to Świnoujście as a Polish territorial sea, German interests are touched again, because 12 nm from the German baseline protrude into this area (can be checked with a simple measurement).
Why now of all times, after the border had been registered differently in OSM for many years, a revision according to Polish legal opinion has taken place, I cannot understand.

https://www.umgdy.gov.pl/?page_id=17781 - zeigt aktuelle polnische Seeverwaltungsgrenzen. Das ist die ofizielle Website der polnischen Seefahrtsbehörde. Wir haben jetzt in osm die Situation:
Deutsche Grenze (in dem Bereich) ist korrekt dargestellt, Deutsche AWZ ebenso. Polnische Seeverwaltungszonen - aus der Sicht Polens - auch ok. Ob Deutschland das anerkennt oder nicht haben wir noch nicht festgestellt. Nehmen wir an, nicht. Wie willst Du das auf der Karte einzeichnen? Jetzt schau dir die deutsch-/niederländische Seegrenze an. Die Deutschen malen was sie wollen (oder für richtig halten), Die Niederländer auch. Die Staatsgrenzen überschneiden sich und ein Stück des Meeres ist zugleich in Deutschland und in Niederlande. Dort hast Du auch politsch/völkerrechtlich nicht gerade klare Verhältnisse. Ich sehe dort (weder in note noch in description) keine Bemerkungen das der Verlauf umstritten ist. Vielleicht wäre das auch hier die Lösung.

Vertrag aus dem 1989 besagt:
"Artikel 5. (1) Die Nordansteuerung zu den Häfen Szczecin (Stettin) und Swinoujscie (Swinemünde) in ihrem ganzen Verlauf und die Ankerplätze befinden sich in den Territorialgewässern der Volksrepublik Polen beziehungsweise auf dem Offenen Meer.

(2) Der Abschnitt der Nordansteuerung zu den Häfen Szczecin (Stettin) und Swinoujscie(Swinemünde), der östlich der äußeren Grenze der Territorialgewässer der Deutschen Demokratischen Republik liegt, wie sie in Artikel 3 dieses Vertrages bestimmt ist, sowie der Ankerplatz Nr. 3 sind kein Festlandsockel, keine Fischereizone und keine eventuelle ausschließliche Wirtschaftszone der Deutschen Demokratischen Republik."

Welche Interessen Deutschlands würden deiner Meinung nach berührt in polnischen Territorialgewässern oder auf offenem Meer? Es steht hier eindeutig dass das schmale Streifen weder deutsche Territorialgewässer, Festlandsockel, noch Fischereizone und keine eventuelle ausschließliche Wirtschaftszone Deutschlands ist. Und die 12 Meilen Zone war auch in 1989 schon schmaler in dem Bereich.

I think it’s because polish border was changed by Regulation of the Council of Ministers of January 30, 2017, so not many years ago… and user Constrado noticed that border in OSM is not valid according to this regulation, and changed it…

Also - I’m sure we’re not first ones finding it… I’m sure there was some consultations, maybe agreements between our governments…

I would be very worried if the violation of borders (if this actually happened - when I find time I will check it for sure) of one country by another was noticed by several amateurs drawing maps in their free time, and not by the governments of these countries.

I’ve visualized the “Treaty between the German Democratic Republic and the Polish People’s Republic on the Delimitation of the Sea Areas in the Oder Bay 22 May 1989”. The interesting part is the map in Article 2 which shows the polish territorial waters boundary.

Article 1
The common boundary between the territorial seas of the German Democratic Republic and of the Polish People’s Republic follows straight lines (geodetic lines) connecting the following points:

Article 2
In the Oder Bay the Polish People’s Republic shall fix the outer limit of its territorial sea in such a way that it follows straight lines (geodetic lines) connecting the following points:

Article 3
In the Oder Bay the German Democratic Republic shall fix the outer limit of its territorial sea in such a way that it follows straight lines (geodetic lines) connecting the following points:

Article 4
The boundary delimiting the continental shelf sections and the fishery zones of the German Democratic Republic and the Polish People’s Republic follows straight lines (geodetic lines) connecting the following points:

Maybe both countries in some parts don’t feel bound to this treaty anymore? There are also official german sources which tell that the “Nordansteuerung” is part of the German EEZ.

Alles klar also. Wir haben eine umstrittene Grenze. Das wird man hinnehmen müssen. Ist halb so schlimm, es gibt doch mehrere (und lange) Abschnite wo deutsche Seegrenze zu Dänemark und Niederlande genauso ausschaut. Wir werden in diesem Forum diese Fragen nicht lösen, wir können aber versuchen das möglichst gut auf der Karte abzubilden. Die Lösung welche Protoxenus anstrebt (polnische Grenze zurückzuschneiden) erscheint mir nicht optimal zu sein. Aus welchem Grund soll in osm nur deutsche Auffassung abgebildet werden? Sollen wir jetzt genauso niederländische und dänische Grenzen zuschneiden? Es gibt eine Relation die Grenze Deutschlands so darstellt wie sie Deutschland auch sieht (deutsche Auffassung). Und es gibt eine Relation die Grenzen von Niederlande so darstellt wie sie die Niederländer sehen. Niemand kommt hier auf die Idee Relation “Niederlande” so zu verändern dass sie nur deutsche Sicht abbildet. Es sind beide Auffassungen korrekt dargestellt. Wieso sollten wir das in Pommerschen Bucht anders machen? Man könnte sogar die Linie der Polen-Relation hier auftrennen und auf dem diskutablem Abschnitt in note oder description dazu schreiben “wird von BRD nicht anerkannt”.

Ein letzter Gedanke noch:

Ich glaube beide halten sich ganz genau an Vertrag von 1990 und deswegen haben wir jetzt unklare Verhältnisse. Der lässt nämlich einiges offen.

Artikel 1 besagt:
Die Vertragsparteien bestätigen die zwischen ihnen bestehende Grenze…

und diese endet (im 1990) im Punkt C.

Artikel 2
Die Vertragsparteien erklären, daß die zwischen ihnen bestehende Grenze jetzt und in Zukunft unverletzlich ist und verpflichten sich gegenseitig zur uneingeschränkten Achtung ihrer Souveränität und territorialen Integrität.

Hier steht nicht dass die Grenzen zu offenem Meer sich nicht ändern können. Und genau das haben die beiden Staaten ausgenutzt. Deutschland erklärt offenes Meer für eigene AWZ und Polen für eigene Territorialgewässer. Grenze zwischen beiden Staaten von 1990 bleibt unverletzt. Und so haben wir jetzt den Salat.
