This post is about webkaart.hoogspanningsnet.com , a map of the high voltage grid, focused on Belgium and the Netherlands. It’s created by volunteers of hoogspanningsnet.com , a site for high voltage enthusiasts in Flanders and the Netherlands. The map is made available under CC BY NC ND 4.0 .
They indicate that they source data from OSM in some cases, in the FAQ and on their forum (e.g. here ). The licences are incompatible however so this usage is illegal. It’s regrettable, I learned about high voltage infrastructure at their site, and I’m able to map it in OSM because of this.
I wrote this message that I would maybe post on their forum. Does anyone see inaccuracies? Perhaps a way out for them, without removing OSM data? Am I overworried?

Data van OpenStreetMap plukken en in een andere databank zoals de netkaart stoppen (en die DB of afgeleide producten verspreiden) is niet toegestaan als die databank niet beschikbaar is onder gelijkaardige voorwaarden als de ODbL . Data combineren van ODbL- en niet-vrije bronnen is niet mogelijk. “Ontdekken” van hoogspanningslijnen zonder informatie over te nemen (dus zelf intekenen vanaf luchtbeelden, voltage afleiden uit andere bronnen) mag wel.
Alle mappers behouden de rechten op hun bijdragen en geven de Stichting OSM een niet-exclusieve toelating om de data in onderlicentie te geven, maar alleen onder de ODbL (zie de Bijdragersvoorwaarden ). Helaas is er dus niemand bij machte om de jure een uitzondering te maken voor de netkaart, en kan ook niemand garanderen dat jullie de facto niet aangeklaagd zullen worden, want m.i. kan elke mapper die substantieel aan HS gewerkt heeft in OSM dat. Zie ook de samenvatting van de ODbL en OSM’s licentie-FAQ .
De opties die ik zie, zijn:
alle data die van OSM zijn afgeleid, verwijderen;
de hele netkaart onder de ODbL beschikbaar stellen en informatie uit niet-compatibele bronnen verwijderen; of
dit negeren en leven met het (waarschijnlijk toch wel kleine) risico.
Ik dacht ook nog aan: in bepaalde gebieden de netkaart onder de ODbL publiceren, en in de rest van de wereld alle OSM-besmettingen verwijderen. Ik weet niet of dat helemaal in orde zou zijn, maar Apple Maps doet het geloof ik zo.
Best wel frustrerend, maar ook in de andere richting is het noppes. OSM-HS-mappers mogen de hoogspanningsnet.com-netkaart niet gebruiken als bron door de conflicterende licenties.
Ik weet overigens niet of van netkaarten kopiëren, zoals in sommige forum-draden hier besproken wordt, wel helemaal koosjer is. Voor OpenStreetMappers is dat alvast niet toegelaten, er is een witter-dan-wit-principe, elke grijze zone dient vermeden te worden. Bijvoorbeeld satellietbeelden en Street View van Google gebruiken we niet (maar we hebben vrije alternatieven voor die allebei), en ook de netkaart van Elia wordt niet geraadpleegd. De netkaart van hoogspanningsnet.com zullen we in OSM dus nooit als bron kunnen nemen.
Het valt me zwaar zulk slecht bericht te moeten brengen en ik zou zelf niets liever willen dan meer kruisbestuiving tussen de netkaart en OSM. Ik zou enkel kunnen mijn eigen OSM-bijdragen ook aan hoogspanningsnet.com in licentie geven, en verder bespreken welke bronnen er gebruikt worden.
Ik ben geen advocaat, dit is geen juridisch advies. OSM heeft een licentiewerkgroep waar wel advocaten bij zijn.

Plucking OpenStreetMap data and putting in another database, like your grid map (and distributing that DB) is not allowed if that database is not available under similar conditions as the ODbL . Combining data from ODbL and non-free sources is not possible. “Discovering” transmission lines without copying (so tracing yourself, sourcing voltage elsewhere) is allowed.
All mappers keep the rights to their contributions and give the OSM Foundation a non-exclusive permission to sublicense them, but only under the ODbL (see the Contributor Terms ). So regrettably nobody is able to give you de jure an exception, and likewise nobody can guarantee that de facto you won’t be sued, since afaik every mapper who contributed substantially to HV in OSM can sue. Also see the summary of the ODbL and OSM’s own licence FAQ .
The options I see are:
purge all data that is derived from OSM;
make available your whole grid map under the ODbL, and remove information from incompatible sources; or
ignore this and live with the (after all probably pretty small) risk.
I was also thinking about: publish under ODbL in some regions, and remove OSM contaminations in the rest of the world. I don’t know if that would be okay, but I think Apple Maps does it like this.
Also frustrating: in the other direction it’s also a no-go. OSM HV mappers cannot use the hoogspanningsnet.com grid map as a source, because of the conflicting licences.
Besides, I’m not sure copying from Transmission Systems Operators’ grid maps, like you say you do in some threads on your forum, is okay. For OpenStreetMappers it’s not permitted in any case, we have a whiter-than-white principle, stay out of every grey zone. For example we don’t use satellite imagery en Street View of Google (but we have free-as-in-freedom alternatives for both), and also the map of Elia [the Belgian TSO] is left aside. So hoogspanningsnet.com ’s grid map will always be off limits for OSM.
It’s hard to have to bring such ill news and I would love for hoogspanningsnet.com ’s map and OSM to cross-pollinate. But I would only be able to dual-licence my own OSM contributions to hoogspanningsnet.com , and for the rest we’re limited to discussions about which sources we use.

Joost Schouppe asked in the Belgian chat channel if I know they’re copying substantially. I think they are:
Would releasing their map data under the ODbL solve it? To comply with OSM’s licence, maybe. Do note that their source policy is more relaxed than OSM’s, so I think we couldn’t copy from them even if they relicensed.
Edit: Joost also said the message felt as heavy as a nuclear bomb, so if I would send it, I would try to soften it first.
I’ll agree it’s a bit heavy, but there’s no soft way to bring a heavy message I guess.
It could be an option to open like ‘err… guys… ? You know that what you’re doing is a bit dodgy right?’, which would most likely be countered with a ‘no, how so?’ in which the above would be the detailed follow-up…
